Car Accidents in Hawaii
Hawaii auto accidents take place far too often. In fact, our state sees over 10,000 serious accidents each year. The state of Hawaii is considered a no-fault state. When people are injured in accidents, they generally pursue claims against their own insurance company. However, if the damages are more than $5,000, then injured victims are able to pursue personal injury lawsuits against the at-fault driver.
In addition to being a no-fault state, Hawaii is also a state that follows the comparative negligence law doctrine. This doctrine specifies that an injured party can receive compensation for their accident up to the amount that the person they are suing is deemed to be responsible. For example, if a driver suffers $100,000 in damages as a result of an accident, and they are found to be 10% liable for the crash, they can receive up to $90,000 from the defendant in a lawsuit.
