Wrongful Death Suits in Hawaii
A wrongful death action is a civil claim, meaning it will be overseen in a civil court and is completely separate from any related criminal case involving the defendant. Anytime a person’s dereliction, misconduct, or negligence results in someone’s death, their surviving family members are entitled to bring a claim of wrongful death against the at-fault party.
As a civil claim, the primary goal of a wrongful death suit is adjudicating whether the respondent is liable for the damages endured by the deceased and their surviving family.
Based on the events leading up to the fatal incident, recovery might be available for damages including:
- Funeral costs/Burial or cremation expenses
- Medical bills amassed prior to death
- Lost income and financial assistance
- Loss of services and support for the household
- Loss of consortium
- Loss of love and guidance
Similar to other civil injury claims, those bringing the suit will have to show that the respondent is liable or otherwise accountable for the death due to their negligence.
