Wrongful death, simply speaking, is that someone has died before their natural time and as a result of somebody’s wrongful act. Often times, wrongful deaths are the result of a driver who has made a choice to not follow the rules of the road.
They are very difficult cases to handle because they are very emotional. It is important that the survivors get justice, and it can be very a very long and drawn out process to get people the justice that they deserve when they lose a loved one. It’s essential to those folks to feel that justice has been provided. The unfortunate part is it usually comes in the form of money, which is never sufficient to compensate them for the loved one they lost. But it does make life easier, so it’s the only thing we can give between each other.
But it also serves a much more important function. It tells us as a community “This is how we valued this person’s life. This is how we value life in this community.” And it tells that person who chose to not follow the rules of the road, or that person who committed the wrongful act, “We valued this life that you took in this amount and you are responsible for that.”
I think that is an essential part of trying g to make sure that that wrongdoer never does it again, but also for everyone else.
