Uninsured or Underinsured Motorist Coverage
Here at Leavitt, Yamane & Soldner, one of the things that we always look at are insurance coverages. What we do is, when our clients come in to talk about these situations, we actually always ask them to bring in their insurance policy. We will sit down with them and go over their coverages and explain to them the types of coverages they have and what coverages are very important. One of the types of coverages we always look at is what we called uninsured motorist coverage and underinsured coverage. Those types of coverages are very important because statistics have shown that 1/3 of the drivers in Hawaii either do not have enough insurance or do not have insurance at all. So, if you have underinsured and uninsured coverage, that extra coverage can protect you against those kinds of drivers. Here at Leavitt, Yamane & Soldner, we feel very strongly about uninsured motorist coverage and underinsured coverage, so strongly that we have been talking to people about it for at least the past 25 years.
We have actually had cases where the insurance company tenders the policy limits. But, just because the insurance company will tender their policy limits, in other words, the insurance company says, “Here. We will pay the full amount of coverage that that person purchased,” just because the insurance company does that does not mean that the driver that caused that accident is necessarily off the hook. The person that caused that accident is responsible for all the harms that he cause
