Two Parts to An Accident Case
A lot of times when people come to see us, they don’t know exactly why they were injured, or they sometimes feel they were just in an automobile accident and they got a serious injury because of it. They don’t realize that maybe the reason they had such a serious injury was that the automobile failed to protect them the way that it should have been designed for. This is what is called a crashworthiness case – a second accident within the accident. There was the first accident, where someone ran into them, and there was the second accident when they collided with some part of the car maybe that they shouldn’t have. Maybe the airbag didn’t function as it was supposed to, or maybe the seatbelt didn’t function as it was supposed to. Maybe the pillars of the car weren’t strong enough to support the roof. And you have a tragic, catastrophic incident where there shouldn’t have been one. We often see situations where there is a bad traffic collision, yet one person survives fine, they walk away from it, and someone else is killed or suffers catastrophic injuries. Oftentimes, that is because the automobile’s safety features did not perform as they should have.
